Terms of Use

Thank you for using Secure AI! These Terms of Use apply to your use of the Secure AI mobile application for iPhone, iPad, and Mac, along with any associated services and websites (collectively, "Services"). By using our Services, you agree to these Terms.

Our Privacy Policy explains how we collect and use personal information. Although it does not form part of these Terms, it is an important document that you should read.

1. Who We Are

Secure AI is a privacy-first AI assistant application for iOS, iPadOS, and macOS. We provide AI-powered conversational assistance while keeping your data private and secure.

2. Registration and Access

Minimum Age

You must be at least 13 years old or the minimum age required in your country to consent to use the Services. If you are under 18, you must have your parent or legal guardian's permission.

Registration

You must provide accurate and complete information to use our Services. You may not share your account credentials or make your account available to anyone else and are responsible for all activities that occur under your account.

Apple ID Integration

Our Services integrate with your Apple ID and iCloud account for authentication and data syncing. By using our Services, you agree to comply with Apple's Terms of Service.

3. Using Our Services

What You Can Do

Subject to your compliance with these Terms, you may access and use our Services. In using our Services, you must comply with all applicable laws.

What You Cannot Do

You may not use our Services for any illegal, harmful, or abusive activity. For example, you may not:

HealthKit Integration

If you grant permission, our Services may access your health data through Apple HealthKit. You control what health data the app can access through iOS Settings. We will only use your health data as described in our Privacy Policy and will never share it with third parties for advertising purposes.

CloudKit Sync

When enabled, your conversation history is synced across your devices using Apple's CloudKit. This data remains in your private iCloud storage and is encrypted. We do not have access to your synced data.

4. Content

Your Content

You may provide input to the Services ("Input") and receive output generated based on your input ("Output"). You are responsible for Content, including ensuring that it does not violate any applicable law or these Terms.

Ownership of Content

As between you and Secure AI, you retain ownership rights in Input and own the Output. We assign to you all our right, title, and interest, if any, in and to Output.

Accuracy

AI output may not always be accurate. You should not rely on Output as a sole source of truth or as a substitute for professional advice. You must evaluate Output for accuracy before using or sharing it.

5. Health Information Disclaimer

IMPORTANT: THE SERVICES PROVIDE GENERAL INFORMATION AND ARE NOT A SUBSTITUTE FOR PROFESSIONAL MEDICAL ADVICE, DIAGNOSIS, OR TREATMENT. ALWAYS SEEK THE ADVICE OF YOUR PHYSICIAN OR OTHER QUALIFIED HEALTH PROVIDER WITH ANY QUESTIONS REGARDING A MEDICAL CONDITION.

IF YOU THINK YOU MAY HAVE A MEDICAL EMERGENCY, CALL YOUR DOCTOR OR 911 IMMEDIATELY.

6. Paid Subscriptions

Billing

If you purchase a subscription, billing is handled through the Apple App Store. Subscriptions automatically renew unless cancelled at least 24 hours before the end of the current period.

Cancellation

You can cancel your subscription at any time through iOS Settings → Apple ID → Subscriptions. Payments are non-refundable except where required by law or Apple's policies.

Changes to Pricing

We may change subscription prices from time to time. Price increases take effect on your next renewal, giving you the opportunity to cancel.

7. Termination and Suspension

You are free to stop using our Services at any time by deleting the app. We reserve the right to suspend or terminate your access if you breach these Terms, or if your use could cause harm to us, our users, or others.

8. Disclaimer of Warranties

OUR SERVICES ARE PROVIDED "AS IS." EXCEPT TO THE EXTENT PROHIBITED BY LAW, WE MAKE NO WARRANTIES (EXPRESS, IMPLIED, STATUTORY OR OTHERWISE) WITH RESPECT TO THE SERVICES, AND DISCLAIM ALL WARRANTIES INCLUDING WARRANTIES OF MERCHANTABILITY, FITNESS FOR A PARTICULAR PURPOSE, AND NON-INFRINGEMENT.

9. Limitation of Liability

NEITHER WE NOR ANY OF OUR AFFILIATES WILL BE LIABLE FOR ANY INDIRECT, INCIDENTAL, SPECIAL, CONSEQUENTIAL, OR EXEMPLARY DAMAGES, INCLUDING LOSS OF PROFITS, DATA, OR OTHER LOSSES.

OUR AGGREGATE LIABILITY WILL NOT EXCEED THE GREATER OF THE AMOUNT YOU PAID FOR THE SERVICE IN THE PRIOR 12 MONTHS OR ONE HUNDRED DOLLARS ($100). THESE LIMITATIONS APPLY ONLY TO THE MAXIMUM EXTENT PERMITTED BY APPLICABLE LAW.

10. Dispute Resolution

Mandatory Arbitration

You and Secure AI agree to resolve any claims through final and binding arbitration, except as set forth below. Before filing a claim, we both agree to try to resolve the dispute informally within 60 days.

Class Action Waiver

YOU AND SECURE AI AGREE THAT DISPUTES MUST BE BROUGHT ON AN INDIVIDUAL BASIS ONLY, AND MAY NOT BE BROUGHT AS A CLASS ACTION OR REPRESENTATIVE PROCEEDING. CLASS ARBITRATIONS AND CLASS ACTIONS ARE PROHIBITED.

Exceptions to Arbitration

This provision does not apply to individual claims in small claims court or injunctive relief to stop unauthorized use of our Services.

11. General Terms

Governing Law

These Terms shall be governed by the laws of the State of Texas, United States, without regard to conflict of law provisions.

Apple Requirements

These Terms are between you and Secure AI only, not Apple. Apple has no obligation to provide maintenance or support for the app and is not responsible for any claims relating to it.

Changes to These Terms

We may update these Terms from time to time. Your continued use of the Services after changes become effective constitutes acceptance.
